The regular rate of pay for piece-rate workers is total compensation for the workweek — piece earnings, rest/recovery premiums, nonproductive time pay, other hourly wages, and any make-up pay — divided by total hours worked. This regular rate is the base used to calculate overtime premiums (0.5x for qualifying hours) and double-time premiums (1.0x for qualifying hours).
Make-up pay bridges the gap between piece-rate earnings and minimum wage for the hours spent producing units (productive hours). Calculate the effective rate as piece pay divided by productive hours. If that is below the applicable minimum wage, make-up pay equals (productive hours x minimum wage) minus piece pay. This must be paid as additional wages and itemized on the pay stub.
Piece-rate pay is common in agriculture (fruit and vegetable picking), manufacturing (garment production, assembly), construction (roofing, flooring), trucking (per load), and some service industries. Each industry may face specific rules — for example, any outdoor worker, not just those in agriculture, may be entitled to recovery periods for heat illness prevention.
California requires itemized wage statements for piece-rate workers showing: total hours worked, piece-rate earnings, the piece rate and number of units for each type of work, rest and recovery period compensation, other nonproductive time pay, and overtime premiums — each listed as a separate line item, in addition to the standard wage-statement items required by Labor Code §226(a).
No. California law guarantees all workers, including piece-rate employees, at least the applicable minimum wage for the hours worked. If a worker's piece-rate earnings fall below minimum wage for their productive hours, the employer must pay the difference as make-up pay, in addition to separately compensating rest, recovery, and nonproductive time.
AB 1513 originally included a temporary affirmative defense (often called a safe harbor) that let employers who made specific back-payments to workers by set 2016 deadlines avoid liability for certain prior rest/recovery and nonproductive-time claims. That original safe-harbor window has long since closed. Today, voluntarily and promptly correcting underpayments and wage-statement errors before a claim is filed can still reduce exposure and demonstrate good faith, but it does not eliminate liability for ongoing violations. This calculator is built on the California Labor Code, specifically §226.2 (AB 1513) and §510 (overtime). All calculations use the formulas and rates outlined below.

Calculation Logic

The calculator performs the following steps in sequence:

  1. Piece-rate earnings: Sum of (units × rate) for all entered piece rates
  2. Productive hours: Total hours − rest hours − recovery hours − nonproductive hours
  3. Minimum-wage compliance: Compares piece-rate earnings ÷ productive hours to the applicable minimum wage; calculates make-up pay (productive hours × min wage − piece earnings) if below
  4. Average hourly rate: (Piece earnings + nonproductive pay + other hourly wages) ÷ (total hours − rest hours − recovery hours), floored at the applicable minimum wage
  5. Rest and recovery premiums: Average hourly rate × rest hours, and × recovery hours
  6. Regular rate of pay: (Piece earnings + rest premium + recovery premium + nonproductive pay + other hourly wages + make-up pay) ÷ total hours
  7. Overtime premium: Regular rate × 0.5 × overtime hours (entered directly, or the portion of straight-time hours exceeding 40/week)
  8. Double-time premium: Regular rate × 1.0 × double-time hours (entered directly)
  9. Nonproductive time pay: Nonproductive hours × hourly rate (floored at the applicable minimum wage)
  10. Total gross pay: Sum of all components
